1. Agreement & Modifications. These Terms and Conditions (“Agreement”) govern your access to and use of our Sites and Programs. We may update this Agreement at any time. Continued use of the Sites and Programs after changes are posted constitutes your acceptance of the updated terms.
2. Privacy Policy. Your use of the Sites and Programs is also governed by our Privacy Policy, available at www.yesway.com and www.allsups.com, which is incorporated into this Agreement by reference.
3. SMS / Mobile Messaging Terms (Telnyx Compliance).

   By opting in to receive SMS/MMS text messages from BW Gas & Convenience Holdings, LLC (including Yesway and Allsup’s), you agree to the following messaging terms:

   • Program Description: When you opt-in to our text messaging program, you may receive promotional alerts, rewards updates, coupons, account notifications, and customer support messages.
   • Message Frequency: Message frequency varies based on your account activity and preference settings.
   • Cost: Message and data rates may apply depending on your mobile carrier plan.
   • Opt-Out / Cancellation: You can cancel the SMS service at any time. Text STOP to 855-697-1213 (or reply STOP to any text message). After sending STOP, we will send you an SMS to confirm that you have been unsubscribed. You will no longer receive SMS messages from us unless you re-enroll.

   • No Mobile Sharing: Mobile information and text messaging originator opt-in data will NOT be shared, sold, or rented to third parties or affiliates for marketing or promotional purposes.
   • Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
4. Ownership & Acceptable Use. All content on the Sites and Programs is the property of the Company or its licensors. You are granted a limited, revocable, non-exclusive license to use the Sites and Programs for personal use only. You agree not to copy, reverse-engineer, scrape, or use our content for commercial purposes without explicit written permission.
5. Eligibility. You must be at least 18 years of age to use our Sites and Programs, or have the express consent of a parent or legal guardian.
6. User Accounts & Orders. You are responsible for maintaining the confidentiality of your account credentials. All online orders are subject to product availability and acceptance by us. Products purchased are for personal use only and may not be resold.
7. User-Generated Content & Submissions. Any feedback, reviews, or comments submitted through our Sites and Programs remain your responsibility. By submitting content, you grant us a worldwide, royalty-free, perpetual license to use, display, and distribute that content.

9. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SITES AND PROGRAMS.
10. Indemnification. You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, employees, and agents from any claims, liabilities, or expenses resulting from your breach of this Agreement or misuse of the Sites and Programs.
